The appellant, the surviving spouse of Russell Grant Bagley, filed a wrongful death action against the State of Arizona and a number of other defendants. The state's motion for summary judgment was granted by the trial court, and a final judgment in favor of the state was entered. Appellant filed a timely appeal.
