The within matter is now before us on defendant Recra-Del Corp.'s petition to set aside a writ of execution and to strike judgment.
Defendant first argues that the judgment in question should be stricken as violative of the Act of June 10, 1935, P.L. 295, sec. 1, 12 P.S. §745. Said statute provides:
"Judgments by agreement Whenever any parties to an action or proceeding at law shall have agreed to the entry...
