The Defendants are charged in a seven-count indictment, Count One of which charges all five Defendants with conspiracy to distribute a quantity of cocaine in violation of 21 U.S.C. § 841(a)(1). Count Four charges Medina-Martinez and Smith with a substantive violation of 21 U.S.C. § 841(a)(1) allegedly occurring on May 11, 1979. Count Five charges Romero-Morquecho and Saenz-De Leon with a substantive violation...
