Johnny Crockett Shipwash comes before this court under 28 U.S.C. § 2254. Mr. Shipwash was convicted of burglary on December 21, 1976, in the Circuit Court of Wythe County, Virginia. Sentence was set at five years in the state penitentiary. A writ of error to the Virginia Supreme Court was rejected on September 13, 1977.
