MEMORANDUM AND ORDER

NICKERSON, District Judge.

Plaintiff brought this action under 42 U.S.C. § 1983, alleging that defendant police officers used excessive force in effecting his arrest on January 26, 1978 for armed robbery.

On April 4, 1979 plaintiff filed a pro se complaint in the Southern District of New York, naming as defendants "Guy Krauss" and "H. McSrunnez". Because these names were incorrect, the Marshal was unable to serve...
