This action was commenced by complaint filed October 15, 1974, by plaintiffs, Waters and Rowland, as a class action pursuant to the Civil Rights Acts of 1964 and 1866 and to 29 U.S.C. § 151. Plaintiffs allege discrimination due to race by defendants Olinkraft and the local Union, and lack of fair representation by the Union.
