On 21 October 1977, upon a plea of not guilty, petitioner Harry L. Wolkind was convicted of violations of Va.Code §§ 18.2-248 and 18.2-250 (Repl.Vol.1975), possession of marijuana with intent to distribute and possession of cocaine. On the marijuana charge he was sentenced to a term of five years, suspended for 20 years on condition that he pay a $1,500.00 fine plus costs and serve nine months in the Henrico...
