MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

The corporate and individual plaintiffs in this case have brought an action against the Town of Cicero, various public officials, and local residents for arbitrary and discriminatory behavior with respect to the licensing of a sawmill owned and operated by the plaintiffs. In Count I plaintiffs allege the actions violated plaintiffs' protected civil rights in violation of 42 U.S.C. § 1983;
