James Rhinehart, petitioner herein, was charged by information with possession of stolen property in the first degree. At the close of the State's case, defendant moved for dismissal claiming that the State had failed to prove a prima facie case. The motion was granted and the court ruled the State had proved neither value nor guilty knowledge. On appeal the Court of Appeals reversed the trial court by a 2 to 1 vote.
