Defendant pled guilty to felony theft, and he was placed on probation for a period of five years. Thereafter he was charged with having violated the conditions of his probation by failing to report to his probation officer and by failing to make restitution. After a hearing, the defendant's probation was revoked, and he was sentenced to serve an indeterminate term not to exceed three years in the state penitentiary.
