Petitioner, Joseph Franklin Edwards, Sr., was convicted in the Circuit Court of Franklin County on December 9, 1968, of breaking and entering and possession of a sawed-off shotgun. He was sentenced to the Virginia State Penitentiary for twenty years with twelve suspended and a five-year sentence to run concurrently with the first.
