At a retrial ordered by the United States Court of Appeals for the Sixth Circuit, the defendant-appellant, Timothy Papp, was convicted of the murder of Roxie Ann Keathley, age nine years. Specifically, Papp was found guilty of (1) deliberate and premeditated murder; (2) murder in the perpetration of a rape; and (3) rape.
