This matter comes before the Court pursuant to petitioner's application for a writ of habeas corpus. Jurisdiction exists under 28 U.S.C. § 2254 (1970).

John Stanley Davis was charged in two separate informations with conspiracy to possess or attempt to possess a controlled substance with intent to deliver, on August 6, 1974, and being an habitual criminal, and with wilfully failing to appear on the drug possession...
