This appeal arises from the appellee's action for declaratory and injunctive relief in the Vigo Superior Court. This court entertains jurisdiction pursuant to Ind.R.App.P. 4(A)(8) as the trial court found Ind. Code § 9-1-4-37(b) (Burns Supp. 1977) to be an unconstitutional infringement upon the appellees' right to freely exercise their religious beliefs.
