BRONSON, J.
Defendant was convicted by a jury on August 13, 1974, of possession with intent to deliver heroin. MCLA 335.341(1)(a); MSA 18.1070(41)(1)(a). On the same date, he was convicted on a supplemental information charging him as an habitual offender. On September 12, 1974, defendant was sentenced to a prison term of from 25 to 40 years.
