Arkansas Louisiana Gas Company (Arkla) and the Federal Power Commission (FPC) had previously filed Motions to Dismiss the Action, alleging that primary jurisdiction was vested in the FPC, and further alleging Wessely's failure to exhaust its administrative remedies...
