Petitioner Kendall Brown was convicted by jury in New York State Supreme Court of the crime of robbery in the first degree on June 13, 1977 and was sentenced to an indeterminate prison term not to exceed seven years. He is currently incarcerated in the Elmira Correction and Reception Center in Elmira, New York.
