The instant appeal arises from appellant's conviction for violating The Controlled Substance, Drug, Device and Cosmetic Act, 35 P.S. § 780-101 (1977) (Hereinafter, CSDD & C). In particular, the jury found appellant guilty of sale at retail of a nonproprietary drug. Id. at § 780-113(a)(10).
