Lawrence Alfano was convicted, following a jury trial, of possession of stolen airline tickets in violation of 18 U.S.C. § 659. The judgment of conviction was affirmed without opinion on May 6, 1976. On August 31, 1976, Alfano filed a motion, pursuant to 28 U.S.C. § 2255, to set aside the judgment of conviction. The motion was granted on January 24, 1977.
