OPINION

BUSSEY, Presiding Judge:

Appellant, William McKinley Provo, hereinafter referred to as defendant, was charged in the District Court, Oklahoma County, Case No. CRF-75-130, with the offense of Murder in the First Degree, in violation of 21 O.S.Supp. 1973, § 701.1. He was convicted by a jury and sentenced to death. From said judgment and sentence, defendant has perfected an appeal to this Court.
