LEE, Judge.

Defendant City of Corvallis appeals from a summary judgment entered by the circuit court declaring "invalid and of no effect" an ordinance creating a local improvement district.

In July of 1975 the owner of seven different lots abutting a portion of Willamette Avenue within the city of Corvallis filed a petition with city officials requesting the creation of an improvement district in order to facilitate the paving of that street.
