MEMORANDUM OPINION AND ORDER

PESQUERA, District Judge.

Plaintiff, a pathologist, filed the present action seeking money damages and injunctive relief from an administrative determination made by the Secretary of Health, Education and Welfare (the Secretary) transferring payment proceedings for services rendered under Part B of the Medicare Program, 42 U.S.C. § 1395j, et seq.1
