Defendant appeals from an order of summary judgment granted by the court below in favor of plaintiff.

On September 15, 1974 a collision occurred involving a motorcycle operated by plaintiff Underhill and an automobile owned by James Hawley and operated by his daughter with Mr. Hawley's consent.
