We granted this application for writ of certiorari to review the judgment and Division 1 of the opinion of the Court of Appeals in Bell v. Loosier of Albany, Inc., 137 Ga.App. 50 (222 S.E.2d 839) (1975). The Court of Appeals divided 6-3 on the issue that we have under review.
