Bailey was convicted in the Superior Court on indictments charging him with rape, and assault with intent to commit rape (G.L.c. 265, §§ 22, 24), and with breaking and entering a dwelling house in the night time with intent to commit a felony, making an assault on a person lawfully therein (G.L.c. 266, § 14).
