This action was commenced on March 14, 1975, when Plaintiffs Alfred Rogers and Rupert Lespeare, nonimmigrant aliens present in the Virgin Islands pursuant to 8 U.S.C. § 1101(a)(15)(H)(ii), filed suit for mandatory, declaratory and injunctive relief.
