Plaintiff's action against the defendants is hereby dismissed with prejudice.

On December 19, 1975, this Court granted plaintiff its request for a preliminary injunction. The Court then was of the opinion that a breach of a Section 2 First duty of the Railway Labor Act (RLA) gives rise to preliminary, injunctive relief.
