Paul Plante initiated this action under 42 U.S.C. §§ 1983 and 1985 alleging that the defendants entered into "a conspiracy to harass [him] and drive him from his position" with the Jacksonville, North Carolina, police department and subsequently "wrongfully discharged" him in violation of the fourteenth amendment. On September 22, 1975, the defendants responded with a motion to dismiss under Rule 12(b) or, in the alternative, for summary judgment...
