In this action brought pursuant to 28 U.S.C. § 2201, plaintiff seeks a declaratory judgment that sections 34 and 45 of chapter 53 and sections 33, 41 and 42 of chapter 54 of the Massachusetts General Laws are unconstitutional as violative of rights guaranteed by the fourteenth amendment.
