Plaintiff brought suit against Delta Airlines, Inc., (Delta) and Piedmont Aviation, Inc., (Piedmont) alleging violation of the provisions of the Federal Aviation Act of 1958, 49 U.S.C. § 1374(b) by Piedmont, and alleging common law fraud and violation of the Texas Deceptive Trade Practices Act by Piedmont and Delta.
