This case comes on to be heard on the motion of the defendants to dismiss the complaint and on motions by both sides for summary judgment. The suit was filed to obtain a declaratory judgment that a certain section of the Municipal Code of the City of Chicago is unconstitutional and for ancillary relief which would result from its unconstitutionality.
