HENDLEY, Judge.

Defendant was convicted of driving while intoxicated contrary to the Traffic Code of the City of Las Cruces. The facts are not in dispute. Defendant was driving at a time when his blood alcohol level indicated that he was under the influence of an intoxicating liquor.
