OPINION

HASTINGS, J.

Defendant was charged by information with robbery. (Pen. Code, § 211.) It was alleged that he used a firearm in the commission of the offense. Defendant pleaded not guilty and waived jury trial. A motion for acquittal (Pen. Code, § 1118) was denied, as was a motion to suppress evidence (Pen. Code, § 1538.5). The court found defendant guilty of robbery, but did not fix the degree of the offense....
