This matter is before us on plaintiff's post-trial motions for judgment n. o. v. or, alternately, for a new trial, pursuant to Fed.R.Civ.P. 50(b) and 59. The case arose from injuries sustained by plaintiff, Wilfred Beron, in a fall from a forklift he was operating in the course of his employment with third-party defendant Victory Metal Manufacturing Co.
