BASHARA, P.J.

In 1970 defendant and Willie Chappel were charged with first-degree murder1 and assault with intent to rob while armed arising out of a holdup of a party store which resulted in the murder of the owner. On October 5, 1970, the people amended the information to include a count of second-degree murder and the defendant pled guilty to that count. On October 30, 1970, defendant was sentenced to from 21 to 31 years in prison....
