On April 12, 1973, plaintiff Super Products Corporation commenced an action against the defendants seeking damages for alleged violations of Section 3 of the Clayton Act, 15 U.S.C. § 14, and a declaration by this Court that United States Letters Patent No. 3,541,631 and Claim 1 thereof are invalid and void and have not been infringed by the plaintiff.
