OPINION

HERNANDEZ, Judge.

Defendant brings this appeal from a conviction by jury and sentence for aggravated battery upon a peace officer contrary to § 40A-22-24, N.M.S.A. 1953 (2nd Repl. Vol. 6). We affirm.
