Defendants-Appellees were arrested by the Albuquerque City Police on November 28, 1973, for alleged possession with intent to distribute and conspiracy to distribute, marijuana, contrary to §§ 54-11-22, N.M.S.A. 1953 (Repl.Vol. 8, pt. 2, Supp. 1973), and 40A-28-2, N.M.S.A. 1953 (2d Repl.Vol. 6). The criminal complaint form, by which the prosecution was initiated, was signed by a detective of the department as complaining...
