Defendant appeals from his conviction by a jury of assault with intent to kill with malice and robbery with a dangerous and deadly weapon. His punishment was fixed by the jury at 65 years on the assault charge and 35 years on the robbery charge.

Defendant raises four points of alleged error but makes no attack on the sufficiency of the evidence to sustain the verdict. The victim of both crimes...
