The defendant has filed a motion to dismiss the third and fourth claims of plaintiffs' complaint. The issue before the Court is whether claims for relief are stated where the claims seek to establish liability on the part of the defendant-broker based upon alleged violations of rules adopted by the New York Stock Exchange and the National Association of Securities Dealers.
