LARKINS, District Judge:

This is a civil action brought under 42 U.S.C. sec. 1985 against several individuals in connection with the September 9, 1970 prosecution of plaintiff for public nuisance. Plaintiff's civil rights were allegedly violated when defendant, the Honorable Herbert O. Phillips, III, allowed the motion of the solicitor to amend the warrant.
