This is an appeal from a summary judgment rendered under the provisions of Rule 166— A, Texas Rules of Civil Procedure. In 1956, the plaintiffs, Leonard B. Owens, et al, conveyed the surface estate of approximately 210 acres of land to defendant, Upper Neches River Municipal Water Authority, by warranty deed.
