Petitioner, Carmello Torres, is presently serving a five-year sentence imposed by this court on January 23, 1973, subsequent to his plea of guilty on November 8, 1972, to an indictment (72 CR 1173) charging him with unlawfully carrying a firearm during the commission of a felony: possession of heroin with intent to distribute. 18 U.S.C. § 924(c)(2).
