BUSSEY, Judge:

Appellant John Robert Sears, hereinafter referred to as defendant, was convicted by jury verdict for the offense of Unlawful Possession of Marijuana with Intent to Distribute, in violation of 63 O.S. 1971, § 2-401, in the District Court, Tulsa County, Case No. CRF-73-1133. In accordance with the verdict, defendant was sentenced to imprisonment in the state penitentiary for a term of eight (8) years and fined in the amount of One...
