This action was brought by the Equal Employment Opportunity Commission (hereinafter "EEOC" or "Commission") pursuant to § 706(f)(1) and (2) of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., as amended by Public Law 92-261 (March 24, 1972).
