The instant action is before the Court on Defendants' Motion to Dismiss the Complaint under Fed.R.Civ.P. 12(b) on the grounds that there is lack of jurisdiction over one defendant and plaintiffs have failed to state a claim upon which relief can be granted with respect to the remaining defendant.
