BRETT, Judge:

Appellant, Richard Carr, hereinafter referred to as defendant, was tried by a jury in a two-stage proceeding in the District Court of Grady County, Case No. CRF-72-53, for the offense of Pointing a Firearm with Felonious Intent, After Former Conviction of a Felony. The jury assessed defendant's punishment at ten (10) years imprisonment. Judgment and sentence was imposed on December 21, 1972...
