We are again thrust into the overexplored thicket of obscenity law. The defendant is charged with promotion, or possession with intent to promote, obscene material, knowing the contents and character thereof, all in violation of subdivision 1 of section 235.05 of the Penal Law, a class A misdemeanor.1 It was tried before the court without a jury.2
