GUBOW, District Judge.

Defendant is charged in Count 1 of a 7-Count Indictment with the offense of attempted aircraft piracy in violation of 49 U.S.C. § 1472(i). Count 4 charges Defendent with knowingly and unlawfully carrying an explosive during the commission of an attempted aircraft piracy in violation of 18 U.S.C. § 844(h) (2).
