The defendant, John M. Brodzik, was indicted with Guy DiViaio on a charge of conspiracy and smuggling in violation of 18 U.S.C. § 545. His codefendant, Guy DiViaio, has pled guilty and has been sentenced by the court. The smuggling charge arose from DiViaio and Brodzik's attempted entry into the United States from Canada on July 16, 1972 in a 1972 Cadillac.
